6.3 Members are encouraged, at the request of other Members, to be ready to enter into negotiations for the conclusion of mutual recognition agreements on the results of each other`s conformity assessment procedures. Members may require that such agreements meet the criteria set out in paragraph 1 and that they be mutually exclusive as to their potential to facilitate trade in the products concerned. 10.7 Where a Member has concluded an agreement with one or more other countries on matters relating to technical regulations, standards or conformity assessment procedures that may have a significant impact on trade, at least one Member of the Party shall communicate to the other Members, through the Secretariat, the products to be covered by the Agreement and shall include a brief description of the Agreement. The members concerned are invited to enter into consultations with other members upon request in order to conclude similar agreements or to organize their participation in such agreements. The TBT aims to ensure that technical regulations, standards, tests and certification procedures do not create unnecessary barriers to trade. The agreement prohibits technical requirements created to restrict trade, as opposed to technical requirements created for legitimate purposes such as consumer or environmental protection.  Its objective is to avoid unnecessary barriers to international trade and to grant all WTO Members the recognition of protecting legitimate interests in accordance with their own regulatory autonomy, while promoting the application of international standards. The list of legitimate interests which may justify a restriction of trade is not exhaustive and includes environmental protection, human and animal health and safety.  The free trade agreements concluded by the United States also contain a chapter containing provisions on technical barriers to trade that must be met in order to receive preferential treatment under the agreement. These chapters can be found under Free Trade Agreements. • Inform members of mutual recognition events and agreements under the TBT Agreement. Although the TBT Agreement applies to a wide range of industrial and agricultural products, sanitary and phytosanitary measures and government procurement specifications are the subject of separate agreements.
The rules of the TBT Agreement help to distinguish legitimate standards and technical regulations from protectionist measures. Standards, technical regulations and conformity assessment procedures shall be developed and applied in a non-discriminatory manner, developed and applied in a transparent manner and, where appropriate, on the basis of relevant international standards and guidelines. The World Trade Organization`s Bulletin of Notifications of Technical Barriers to Trade (WTO-TBT) is a weekly publication of notifications by WTO Members under the TBT Agreement on their notified draft technical regulations and conformity assessment procedures. 3. Citizens of the parties to the dispute may not be active in a group of technical experts without the joint consent of the parties to the dispute, unless the panel considers, in exceptional cases, that the need for specialized scientific expertise cannot be met by other means. Government representatives of the parties to the dispute are not allowed to attend a group of technical experts. Members of technical expert panels serve in their individual capacity and not as representatives of the government or an organization. Governments or organizations are therefore not allowed to give them instructions on matters before a group of technical experts. In addition to the reporting obligation, each WTO Member must set up a national en-information point. It serves as a point of contact when other WTO Members may request and receive information and documentation on upcoming or adopted technical regulations, standards and test procedures by a Member, as well as on participation in bilateral or plurilateral agreements on standards, regional standards bodies and conformity assessment systems (Article 10). .
